Terms of service
This is a draft. It is not in effect, and nobody is bound by it. It will be replaced by approved terms before Landmate opens to the public.
The parties
These terms govern your use of the Landmate website and app, operated by Charlie Ingoglia ("Landmate", "we", "us"), TODO(owner-approval): postal address. By creating an account you agree to them for yourself and on behalf of the organization you act for. You must be at least 18 years old to use Landmate.
The service
Landmate is software for managing rental properties. It is in early development. Features described as "planned" or "not yet available" on this website are not part of the service until they are released. We aim for the service to be available and accurate, but it is provided "as is" and we do not guarantee uninterrupted availability.
The demo
"Try the demo" opens a private sample workspace for one visit (about two hours), not an account of your own. It is deleted automatically when the visit ends, and nothing in it is backed up, exportable or recoverable. Do not put real information into it: not your residents' or customers' records, not anyone's personal information, and nothing confidential. The demo has limits per person, per network address and per browser, is provided "as is" with no availability commitment, and we may change it, limit one person's access to it or withdraw it at any time, in particular where it is used automatically, at volume, or in a way that spoils it for others.
Accounts and workspaces
- You must give accurate information and keep your sign-in details secure.
- A workspace belongs to the organization that created it. Its Owners decide who may access it and with which role.
- You are responsible for the activity of the members you invite.
- You must not use the service to send spam or for any unlawful purpose.
Your content and data
Everything you and your members put into Landmate remains your organization's property. You grant us only the license needed to store and process it to provide the service. You are responsible for having the right to upload it, including any personal information about residents or other people. You can export your data at any time.
Acceptable use
Do not misuse the service: no unlawful activity, no attempts to access other workspaces or to break security controls, no malware, no excessive automated use outside the API, and no use that harms other customers.
AI assistant
The optional AI assistant suggests and drafts. Its output can be wrong. It does not send, change or collect anything without a person's explicit approval, and you are responsible for what you approve. See the AI disclosure.
Fees
Paid plans are billed through Stripe, monthly or yearly, as described when you subscribe. A paid plan renews automatically at the end of each billing period until you cancel.
You can cancel at any time from the workspace's billing settings, before the next renewal. Canceling takes effect at the end of the current billing period and stops future charges. You keep access through the end of the period you have already paid for.
Landmate does not collect rent or any other payment on your behalf.
Refunds
Payments are generally non-refundable. Landmate may make an exception at its discretion. To request a refund, contact us at the address below.
Suspension and termination
You may close your account or delete your workspace at any time after exporting your data. We may suspend an account or workspace that breaches these terms, and where practical we will warn you first.
Inactive workspaces. A workspace that pays nothing and that nobody signs in to for a year is paused, and we email the workspace Owner when that happens. Nothing is deleted by the pause, and signing in undoes it immediately. If nobody signs in for three months after the pause, the workspace may be deleted along with everything in it. Signing in at any point before the deletion stops it. Paid workspaces and workspaces inside their trial are never paused for inactivity. The full retention rules are in our privacy policy.
Liability
To the fullest extent permitted by law, our liability for any claim arising from the service is limited to the fees you paid in the twelve months before the claim.
Governing law
These terms are governed by the laws of the State of New York, United States.
Changes
We may update these terms; the date above reflects the latest revision. Material changes will be announced in the app before they take effect.
